This Privacy Policy explains how Magnetix Connect LLC (“we,” “us,” or “our”), operating under the trading brand NomenDigital Agency, collects, uses, discloses, and protects personal information in connection with our website at www.nomendigital.agency (the “Site”), our advertising on third-party platforms, and the marketing services we provide (collectively, the “Services”).
Please read this policy carefully. By using the Site or submitting information to us, you acknowledge the practices described here.

NomenDigital Agency is a trading brand of Magnetix Connect LLC. All services described on this Site are provided by Magnetix Connect LLC.
For personal data of individuals located in the European Economic Area or the United Kingdom, Magnetix Connect LLC acts as the data controller in respect of information collected through the Site and our own marketing activities. Where we process client data on behalf of a client, we act as a processor under the terms of our services agreement with that client.
2. Information We Collect
2.1 Information you provide directly
- Contact and lead information — first and last name, business email address, phone number, company name, job title, website URL.
- Qualification information — details you volunteer about your business, such as service area, current marketing spend, budget range, timeline, crew capacity, goals, and current challenges.
- Scheduling information — the date, time, and time zone of any consultation you book with us, along with any notes or agenda items you supply.
- Newsletter subscriptions — the email address you submit through any subscription form on the Site.
- Communications — the content of emails, text messages, contact form submissions, chat messages, and correspondence you send us, including any attachments.
- Call and meeting content — where you have consented, notes, recordings, or transcripts of sales or discovery calls.
2.2 Information collected automatically
- Device and connection data — IP address, browser type and version, operating system, device type, screen resolution, and language settings.
- Usage data — pages viewed, time on page, scroll depth, referring and exit URLs, links clicked, and the dates and times of your visits.
- Campaign data — UTM parameters, click identifiers (such as
fbclidandgclid), and the advertisement, ad set, or campaign that referred you. - Cookies and similar technologies — see Section 6.
2.3 Information from third parties
- Meta lead forms — when you submit an instant form on Facebook or Instagram, Meta transmits to us the information you entered into that form, together with a lead identifier and the campaign, ad set, and ad that generated the submission.
- Advertising and analytics platforms — aggregated and event-level measurement data from Meta, Google, and similar providers.
- Business data providers and public sources — publicly available business information used to verify or enrich a lead record, such as company size, service area, licensing status, and publicly listed contact details.
We do not knowingly collect sensitive personal information such as Social Security numbers, precise geolocation, financial account credentials, health data, biometric identifiers, or information about racial or ethnic origin, religious beliefs, sexual orientation, or union membership. Please do not send us such information.
3. How We Use Personal Information
- Responding to inquiries — to contact you about a request, proposal, or consultation you asked for.
- Providing our Services — to deliver, administer, and support the marketing services we agree to perform.
- Qualification and follow-up — to evaluate whether our services fit your needs and to conduct follow-up outreach by email, phone, or text message.
- Marketing and advertising — to send newsletters, case studies, and offers; to build and refine audiences for advertising campaigns; and to measure and improve advertising performance.
- Conversion measurement — to report back to advertising platforms which leads progressed to qualified opportunities or clients, so that those platforms can optimize ad delivery. See Section 5.
- Analytics and improvement — to understand how the Site is used and to improve its content, structure, and performance.
- Security and fraud prevention — to protect the Site and our systems from abuse, spam, and unauthorized access.
- Legal compliance — to comply with applicable law, respond to lawful requests, and establish, exercise, or defend legal claims.
3.1 Legal bases (EEA and UK visitors)
Where the GDPR or UK GDPR applies, we rely on the following legal bases:
- Consent (Art. 6(1)(a)) — for non-essential cookies, advertising and analytics technologies, marketing email, and call recording. You may withdraw consent at any time.
- Contract (Art. 6(1)(b)) — to take steps at your request prior to entering a contract and to perform a contract with you.
- Legitimate interests (Art. 6(1)(f)) — to operate and secure our Site, to conduct business-to-business outreach, and to understand and improve our Services, where those interests are not overridden by your rights.
- Legal obligation (Art. 6(1)(c)) — where processing is required by law.
4. Text Messages and Phone Calls
If you provide your phone number through one of our forms, you agree that we may contact you at that number by phone call and by text message regarding your inquiry, including through automated dialing or texting technology. Consent to receive marketing texts or calls is not a condition of purchasing any goods or services.
Message and data rates may apply. Message frequency varies. To stop receiving text messages, reply STOP to any message. For help, reply HELP or email hello@nomendigital.agency. To be added to our internal do-not-call list, email us at the same address.
Where you have consented, calls may be recorded or transcribed for quality, training, and record-keeping purposes. You will be notified at the start of any recorded call and may decline recording.
5. Advertising Platforms and Conversion Measurement
5.1 Meta (Facebook and Instagram)
- Meta Pixel — a browser-based tag that records certain actions you take on the Site and associates them with your Meta account where one exists.
- Meta Conversions API — a server-to-server connection through which we may transmit event data (such as a page view, form submission, or booked call) directly to Meta. This data may include hashed identifiers derived from your email address, phone number, name, and IP address. Hashing is applied before transmission.
- Meta lead forms — instant forms hosted on Meta platforms. Information you submit in these forms is collected by Meta and transmitted to us. Meta’s own handling of that data is governed by the Meta Privacy Policy.
- Conversions API for Leads — we may transmit to Meta the status of a lead as it progresses through our sales process (for example, contacted, qualified, or closed), linked to the lead identifier Meta assigned. Meta uses this to improve targeting for future campaigns.
Meta acts as an independent controller in respect of data it receives. To manage how Meta uses data about you for advertising, visit your Meta Ad Preferences.
5.2 Google
We use Google Analytics 4 and Google Tag Manager to measure Site traffic and campaign performance, and we may use Google advertising products. Google Analytics sets cookies and processes IP addresses and usage data. You can prevent Google Analytics from collecting your data by installing the Google Analytics Opt-out Browser Add-on. Google’s handling of data is described in the Google Privacy Policy.
5.3 “Sale” and “sharing” disclosure
We do not sell personal information for money. However, our use of advertising cookies, the Meta Pixel, and the Conversions API may constitute a “sale” or “sharing” for cross-context behavioral advertising under the California Consumer Privacy Act and comparable state laws. You may opt out at any time — see Section 9.
6. Cookies and Similar Technologies
- Strictly necessary — required for the Site to function, including security, load balancing, and remembering your privacy choices. These cannot be disabled through our consent tool.
- Analytics and performance — help us understand how visitors use the Site (for example, Google Analytics).
- Advertising and targeting — used to deliver and measure advertising, and to build audiences (for example, the Meta Pixel).
- Functional — remember preferences such as language or previously submitted form data.
Visitors in the European Economic Area and the United Kingdom are asked for consent before any non-essential cookie is set, and nothing beyond strictly necessary technologies runs until consent is given. Visitors in the United States and elsewhere may opt out at any time. You can change your choices through the Cookie Preferences link in the Site footer, and you can block or delete cookies through your browser settings. Blocking cookies may affect Site functionality.
We honor Global Privacy Control (GPC) signals as a valid opt-out of the sale and sharing of personal information for the browser transmitting the signal.
7. How We Disclose Personal Information
- Service providers and processors — website hosting, customer relationship management, email and SMS delivery, calendar and scheduling, analytics, call recording and transcription, cloud storage, and payment processing.
- Advertising platforms — Meta and Google, as described in Section 5.
- Professional advisors — lawyers, accountants, and auditors, where necessary.
- Legal and regulatory recipients — courts, law enforcement, and regulators where we are legally required to disclose, or where disclosure is necessary to protect our rights, safety, or property.
- Business transfers — a buyer or successor in the event of a merger, acquisition, financing, reorganization, or sale of assets.
We require service providers to process personal information only on our instructions and to maintain appropriate confidentiality and security measures.
We do not sell personal information to data brokers, and we do not disclose personal information to third parties for their own independent marketing purposes.
8. International Data Transfers
We are based in the United States, and our service providers may process personal information in the United States, the European Union, and other countries. Data protection laws in these countries may differ from those in your jurisdiction.
Where we transfer personal data out of the EEA or the UK, we rely on appropriate safeguards, including the European Commission’s Standard Contractual Clauses and the UK International Data Transfer Addendum, together with supplementary measures where necessary. 9. Your Privacy Rights
9.1 United States — California, Virginia, Colorado, Connecticut, Texas, Oregon, and other states
Depending on your state of residence, you may have the right to:
- Know and access the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of third parties to whom we disclosed it.
- Delete personal information we hold about you, subject to legal exceptions.
- Correct inaccurate personal information.
- Opt out of the sale or sharing of personal information and of targeted or cross-context behavioral advertising.
- Limit the use of sensitive personal information — we do not use or disclose sensitive personal information for purposes that trigger this right.
- Data portability — receive a copy of your personal information in a portable format.
- Non-discrimination — we will not deny you services, charge different prices, or provide a different level of quality because you exercised a privacy right.
- Appeal — if we decline your request, you may appeal by replying to our decision. If your appeal is denied, you may contact your state attorney general.
To opt out of the sale or sharing of your personal information, use the “Do Not Sell or Share My Personal Information” link in the Site footer, transmit a Global Privacy Control signal, or email hello@nomendigital.agency.
To exercise any other right, email hello@nomendigital.agency with the subject line “Privacy Request.” We will verify your identity by matching the information you provide against our records, and may request additional information where necessary. We respond within 45 days, and may extend by a further 45 days where reasonably necessary, with notice to you.
An authorized agent may submit a request on your behalf with written proof of authorization.
9.2 EEA and UK
If you are located in the EEA or the UK, you have the right to access, rectify, erase, restrict, and port your personal data; to object to processing based on legitimate interests or carried out for direct marketing; and to withdraw consent at any time without affecting the lawfulness of processing carried out before withdrawal.
You also have the right to lodge a complaint with your local supervisory authority. In the United Kingdom this is the Information Commissioner’s Office (ico.org.uk).
9.3 Marketing opt-out
You can unsubscribe from marketing email at any time using the link in the footer of any message, or by emailing us. We will still send transactional messages relating to an active engagement.
10. Data Retention
- Leads that do not become clients — up to 24 months from the last interaction, then deleted or anonymized.
- Client records — for the duration of the engagement and 7 years thereafter, to meet tax, accounting, and legal recordkeeping obligations.
- Call recordings and transcripts — up to 12 months, unless a longer period is required for a specific engagement.
- Analytics data — in accordance with the retention settings of the relevant platform, generally 14 months.
- Marketing subscribers — until you unsubscribe, plus a suppression record retained indefinitely so that we can honor your opt-out.
- Consent records — a log of privacy choices is retained for as long as necessary to demonstrate compliance.
11. Security
We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. These include encryption in transit, access controls limited to personnel who need the information, multi-factor authentication on business systems, and vendor due diligence.
No method of transmission or storage is completely secure. We cannot guarantee absolute security, and you transmit information to us at your own risk.
12. Children’s Privacy
Our Services are directed to businesses and are not intended for individuals under the age of 16. We do not knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, contact hello@nomendigital.agency and we will delete it.
We do not sell or share the personal information of consumers under 16 years of age.
13. Third-Party Links
The Site may contain links to third-party websites and services that we do not control. This policy does not apply to those sites. We encourage you to review the privacy policy of any third-party site you visit.
14. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date at the top of this page. If we make material changes, we will provide additional notice, such as by email or a prominent notice on the Site. Your continued use of the Site after an update constitutes acceptance of the revised policy.
